Gun Stories Kyle Rittenhouse Vs Protesters/Rioters
I want to start by saying there is not enough information in this case to make a judgment one way or the other. I would normally not write a story this early on and if retractions are needed later. I will apologize and happily make them as needed. This story has highlighted the wrongdoings and what went wrong and when. It is not who was right or who was wrong, it is about the mistakes that were made. Kyle Rittenhouse is learning the hard way how 20 miles away the laws can change drastically.
As firearm owners, it is up to us to follow the laws and to try and avoid situations that will force us into a self-defense situation. That is not to say we can’t live life like anyone else. It simply means we must be aware that we will be held to a higher standard than the rest of the people. I was once asked if I thought a person had to wait until they were being beaten to death before they could defend themselves. My reply was no if you know that person is going to beat you to death you don’t have to wait to defend yourself. Now of course I am not an attorney and just because I study cases and legal issues. I don’t have the right to give someone legal advice. Which is why I said defend yourself and not lethal force. Only you can determine the level of force needed to end an attack. If your thought is to end every attack with lethal force, it is likely you won’t be reading this from the comfort of your home. Lethal force requires that many things be true all at the same time.
Kyle Rittenhouse Vs Rioters
This appears in the videos & court filing:
On August 25th, 2020 Kyle Rittenhouse was walking with reporter Richard McGinnis south down Sheridan rd. Where he described himself as a trained medic. Another armed male approached stating he was there to protect Mr. Rittenhouse. Mr. Rittenhouse had then moved from the middle of the road over to the sidewalk when Joseph Rosenbaum 36 tried to engage him. While Mr. Rittenhouse was trying to walk Mr. Rosenbaum kept trying to get closer until he finally Mr. Rittenhouse did a “juke” move and started running from Mr. Rosenbaum. At which point other people also started chasing him as well.
Mr. Rittenhouse was doing his best to escape. Upon reaching the dealership, Mr. Rosenbaum threw what appeared to be a plastic bag at Mr. Rittenhouse. Within seconds a loud gun shot rang out. Mr. Rittenhouse turned around with his firearm, which was still pointed at the ground. Mr. Rosenbaum made another attempt to grab Mr. Rittenhouse firearm.
According to Mr. McGinnis he believes the first shot then hit the pavement before Mr. Rittenhouse was able to bring the firearm up and engage Mr. Rosenbaum. It is unclear whether Mr. Rosenbaum had his hands on the firearm when he was shot. Although it was stated that he was definitely making quick moves to try and grab it.
The video shows Mr. Rittenhouse initially making his way toward Mr. Rosenbaum while he was on the ground. Mr. McGinnis quickly removed his shirt to cover the head wound on Mr. Rosenbaum. At which point Mr. Rittenhouse made a call and started to make his way back in the direction of the hospital, which was also the direction that law enforcement was in.
A group of multiple people then started to run after Mr. Rittenhouse. One person can be heard yelling “Beat him up!’ while another can be heard saying “ Hey, he shot him!”. In the next video, you can hear “Get him! Get that dude!” at which point one person is seen throwing a wild swing that hits Mr. Rittenhouse along the side of the head, knocking off his hat. The next protesters asked “What’d he do? A response of “Just shot someone” can be heard. With a final voice saying, “Get his ass!”.
Mr. Rittenhouse then trips and falls. As he goes to bring his firearm up and shoot, another protester jumps in the air attempting to kick him in the head. Almost instantly, Anthony Huber, 26 comes up from behind and hits Mr. Rittenhouse in the head with a skateboard and attempts to grab the firearm. He is then shot and staggers away falling to the ground.
Gaige Grosskreutz, 26 was within a few feet of Mr. Rittenhouse with a firearm in his hand. As a result, Mr. Rittenhouse then shot him in his arm. Mr. Grosskreutz then ran away in the opposite direction screaming for a medic. To be clear, in both cases when the attacks stopped Mr. Rittenhouse stopped firing.
The police encounter
Mr. Rittenhouse then got back to his feet and turned towards the police briefly when more shots can be heard down the street. Mr. Rittenhouse turned toward the shots while walking backwards and then went back in the direction of the police.
He can be seen walking down the street with his arms raised in an attempt to surrender to the police. The protestors were yelling to law enforcement that he had just shot someone.
The local police had stated at the time they had received a call of shots fired; however, no mention of someone being shot. Their focus was to get to the scene of the shots and drove right past Mr. Rittenhouse.
Medical Examiners Officer
The Medical Examiner Dr. Kelly determined that Joseph Rosenbaum had been shot in the right groin which fractured his pelvis. A gunshot to the back which perforated his right lung and liver. Another gunshot to his left hand and superficial gunshots to the left thigh and right side of his forehead.
As for Anthony Huber Dr. Kelly stated that he was shot in the chest which perforated his heart, aorta, pulmonary artery, and right lung.
The person Mr. Rittenhouse called was identified as Dominic Black. At which point Mr. Rittenhouse had told him he shot someone. There is no mention of his response or what Mr. Rittenhouse did next. What we do know is that Mr. Rittenhouse had to return the AR 15 back to its owner prior to heading home. Meaning the reports that he crossed state lines with the firearm are largely incorrect.
It was later reported that the ones chasing him down the street were trying to prevent him from leaving and were also trying to secure his weapon. One claim is that after the first attack ended, Kyle was leaving the scene to avoid further confrontation.
It was also claimed that he fled Wisconsin in an attempt to avoid prosecution. I cannot speak to why Kyle did this; however, Kyle turned himself in after returning home and he learned about the warrant for his arrest.
Prior to the Shooting
Kyle was seen on video with the militia earlier in the evening. They were approached by protestors/rioters where an argument broke out about what they were wearing and why they were armed. In a separate video Mr. Rosembaum can be heard saying “Don’t point no mother—— gun at me homie.” “Shoot me n—-! Shoot me n—–!” to the militia members.
Kyle was also recorded on two occasions where he was asked why he was there that night. His response was (I’m paraphrasing here) to help protect the property of a business, and to help anyone that needs medical attention. He stated that he would put himself in danger to help someone else.
The rifle he claimed was for his protection and the medical kit he was carrying was to help anyone who needed it. During one of the videos, you can see Kyle’s face was visually wet, which he claimed was from being pepper-sprayed by protesters walking by. He then saw a person being assisted down the street and went over to offer help claiming he was an EMT.
There are countless videos of the night in question. Many of them show the rioters breaking windows on cars, lighting them on fire, and looting. One argument has been that Kyle had no right to be there to begin with, especially armed. While it is true that being armed at a protest is not the best idea a person can have. He had the same right as everyone else that was there. Many people drove much farther than he did to get there.
Let’s also be clear at this point in the evening, this was no longer a protest, it was a riot. Kyles decision making aside, anyone being chased by rioters would be in danger. What was their intended goal when they caught him? I am guessing it was not to ask about his life, or how he felt about what happened to Jacob Blake. At the same time, the claim that the one’s chasing him after he shot Mr. Rosembaum only wanted to prevent him from doing further harm.
How was Kyle supposed to know their intention at this point? There yelling kick his ass, get him, and he shot someone. He was just attacked by one group and felt like he needed to get away from the crowd to be safe. The video clearly shows they were not yelling hey stop, we just want to make sure no one else gets hurt.
At the same time, Kyle was not yelling anything back that let them know he was just scared for his life and that he just wanted to get to the police. That he could clearly see a couple of blocks up the road.
Neither side knew the other’s intention. The protesters/rioters didn’t know if Kyle was a mass shooter and Kyle didn’t know why they were going to kill him. Plenty of them had weapons that night, firearms were being shot off in multiple videos.
Cars were being smashed and caught on fire; it is likely Kyle had never seen anything like this before. To be clear an object that can bust out a car window most certainly can be used as a deadly weapon. We are talking about a 17-year-old, who isn’t even considered capable of being able to vote yet.
Due to the fact that these guys are listed as the victims on the reports there just isn’t a lot of information. A lot of states refuse to give the names of victims.
Joseph Rosenbaum, 36 has been described as sweet and loving. He was a native of Texas and just recently moved to Kenosha. Along with the fact that he has a fiancé and a young daughter that he left behind.
Anthony Huber, 26 has been described as a talented skateboarder, peaceful and loving. One friend actually stated that he was not a person that looked for trouble, instead, he described him as a defender. Mr. Huber lived in Silver Lake about 15 miles away, around the same distance as Kyle Rittenhouse. It is entirely likely that he thought he was dealing with a crazed shooter and attacked thinking he was defending someone.
Gaige Grosskreutz, 26 is from West Allis, 30 miles north of Kenosha. It has been reported that Mr. Grosskreutz has volunteered as a medic for Black lives Matters. Which is the reason he was at the protest that evening. It is clear from his background that he was also a person who just wanted to help others. He may have had his firearm out thinking he may need to defend himself. His goal very well could have been to help the people he saw as victims.
Kyle knew for years what he wanted to be when he grew up and that was a police officer. He spent time with the Illinois Police Explorer program hoping to one day become a police officer. Upon learning about the call to arms from “Kenosha Guard Militia”, it was reported Kyle and some friends decided to go help. The specific call from the militia was asking other militia members to come to Kenosha to help the police and protect local businesses.
Kyle thought he could go help as misguided as it sounds. If you don’t know, most of the business insurances do not cover rioting. Leaving business owners left with their loans, and no business to cover expenses. I was unable to confirm how Kyle got to Wisconsin. What is confirmed is the fact that he only lived about 20 minutes from Kenosha. It is 21.1 mi from Antioch Il. to Kenosha Wi. Reports have stated he rode with friends, social media claims his mom took him
To start with Kyle Rittenhouse has been charged and is in custody, his charges:
- First Degree reckless homicide-use of a dangerous weapon,
- First Degree Recklessly Endangering Safety-use of dangerous weapon.
- First Degree Intentional Homicide-use of a Dangerous Weapon,
- Attempted First Degree Intentional Homicide-use of a dangerous weapon.
- First Degree Recklessly Endangering Safety- use of a dangerous weapon,
- Possession of a Dangerous Weapon by a Person Under 18.
He is looking at a maximum of one life sentence plus 146 years, 4 months with an additional 5 years for each deadly weapon charge (25yrs). While self-defense must be proven in all cases. Kyle is on an uphill battle; his first obstacle is Wisconsin law.
[18 U.S.C. s. 922 (x) (2).] Under Wisconsin law, with certain exceptions for hunting, military service, and target practice, a person under age 18 is generally prohibited from possessing or going armed with a firearm. There is the possibility his attorneys will be able to bypass this law based on the hunting statue.
That will be left to the judge to decide in this case. There is still the issue of using self-defense, as opposed to the claim of citizen’s arrest that was supposedly being attempted. Was he an unwilling mass shooter or was he protecting his life? Only a jury can answer that now. There is no “Stand Your Ground” law in Wisconsin, although Kyle did not stand his ground he ran.
What Could have been avoided
Kyle could have ignored his desire to help people and stayed home that evening. He also could have taken the chance of facing rioters unarmed. You can make the argument had he not been armed he would not have been chased down. You could also make the argument by being out there helping people he still would have been chased down. If he had been unarmed, he would have likely been the one killed that evening or at the very least been in danger of receiving great bodily harm.
Mr. Rosenbaum could have just left him alone and not tried to engage him or take his weapon. The group chasing him down simply could have called the police and taken a photo of the shooter. The shooting had ended, and the threat was over pursuit was not necessary. Everyone trained in firearm self-defense knows once the threat has ended your right to defend yourself has ended as well. Finally, Kyle could have just went to the police station and turned himself in.
There is no possibility that after the course of events. Kyle was thinking clearly for at least a day or two, depending on how his brain perceived the attack will determine how long that fog lasted. You can read about the brain’s reaction here. The same reactions were likely happening to Mr. Grosskreutz and others involved as well. One thing is clear, he could not have stayed at the riots any longer. Going home was probably the only thing he could think to do.
Militia Vs Movement
The Kenosha Guard militia and the Boogaloo Movement deny any affiliation with Kyle. The Kenosha Guard supports the police and tried to help support the local business. The shame of it is the owner of the car lot that was being destroyed and vandalized when the shooting started was reported as an avid supporter of BLM.
The Boogaloo movement on the other hand is against the police and discredit their authority. Their stated goal is to force a civil war through the racial divide. They have been a part of the riots in Minnesota, North Carolina, Texas, and now Wisconsin. These are just the ones we know they have been seen at or claimed to have been part of.
The group called Antifa has been labeled as the starters of many of these riots and had one self-proclaimed member state that he was part of the riots in Nashville. I was unable to find proof that Antifa was at any other riots or even had a leader of the group anywhere.
Boogaloo on the other hand has taken credit for riots at multiple locations around the U.S. They also have been photographed infiltrating BLM members early on during some of the protests which later turned violent. Why does any of this matter? Because Boogaloo is pushing for these incidents across the nation.
You can see the political divide across the country on this one matter alone. One side is making Kyle out to be a cold-blooded killer. While the other side makes him out to be a hero of self-defense. I see neither side as being correct in this case. What we have is 4 victims, with two of them never returning to their families and one likely just ended his own life.
Videos show BLM leader pushing for peaceful protest and getting it up to a point during the day. Come evening time he was trying to put himself in front of those starting the riots only to be ignored as they threw fireworks at the police line. This is largely the reason I put protestors/rioters in multiple location throughout this story. There were still peaceful protestors there however, more violent rioters were taking over.
Protest are prime targets for anyone looking to start a riot, the group mentality has been studied to death. It shows how normal law-abiding citizens get caught up in the moment and end up doing things they would not normally do once the violence breaks out. It simply takes someone to start it and others eventually fall in line.
These riots do two things politically, one they make it look like the Democrat support the violence which cost them votes. It also makes it look like the Republicans have lost control and need to act which cost them votes. Both outcomes mean more violence and a greater divide.
So why is what Boogaloo doing so important because they are pushing for something that will happen if this doesn’t end. BLM needs to start pulling their people out earlier so the National Guard and Law Enforcement can move in sooner. Legitimate protestors need to vacate before these groups show up.
There are now 4 victims in this case. Two dead, one injured and one destroyed. It only gets worst from here. The division is growing around the nation and what makes matters even worst is the mass amount of false information spreading like wildfire on social media. Today I read an article showing how BLM is posting Kyles address, his sisters address, and his grandmothers address. With calls to visit those location and respond with force.
How true are these posts, does it even matter at this point? It is out there and if it’s not true it will now become true. What you are also seeing is who started this and who is to blame arguments. Notice in this whole story the police officer and Jacob Blake were not part of it. We have already moved past George Floyd and Jacob Blake, and into the realm of hate.
People are just waiting for the next mistake. Videos are going viral of a white racist, and minority groups attacking white people that are walking by. Most of this country is not taking part in what is going on. However, with the spreading of false information on social media, call to arms is going out quickly and being answered.
It is taking a small population of bad people and increasing their numbers daily by convincing others they are on the side that is right. While promoting the evil of the other. Both sides now believe they are under attack and yet notice one very important thing. None of the groups that anyone was out there to support in any area around the country. None of those groups were there in their defense or protection as the events unfolded.
It was not my desire to write this story. Instead the stream of misinformation, false claims and general hate on social media, has left me with no choice. There will be more information that comes out and I will follow the court documents not the media in this case. NBC just came out pausing the video while Kyle was on the ground and then playing the audio of the shots.
Their claim was he was just sitting on the ground randomly shooting into the crowd. They ignored the guy jumping and kicking him, they ignored him being hit with the skateboard, they ignored the guy holding the firearm a few feet from him. Just as the claims that Kyle is some kind of hero are wrong as well.
He may have been there to help and got caught up in a horrible situation. As a result, I am positive based on my research this 17yr old is not proud nor does he feel like he was a hero that night. This was not a cold-blooded killer. He likely shouldn’t have ever even been there, the guy claiming to be there to protect him failed. Should he be punished, or will he be punished, that is now up to a jury.
